A felony is more serious than a misdemeanor. Typically, a misdemeanor is a crime that carries one year or less – the possible punishment does not exceed one year. Felonies are considered much more serious. A felony can be something that carries a lengthy prison sentence.
In South Carolina, that line is blurred a little bit because misdemeanors could carry up to two or three years.
The reality of it though is, if you were convicted of a misdemeanor in South Carolina, the rest of the world would consider it a felony if it in fact carries more than a year. So, that could be something to avoid or something to watch out for. Other states are going to interpret that, the federal government will interpret it, and there’s pretty much a universal rule based on what I said earlier. In South Carolina, on the statute it could say misdemeanor, but other states, the federal government, employers and a lot of other people would classify it as a felony and it would have the implications of having a felony conviction.
