Federal sentencing guidelines work based on the factors of the crime the person is convicted of. For example, if it’s a fraud crime involving money, the loss amount (the amount of money that’s alleged to have been taken) is a factor. If it’s a drug case, then the amount of drugs that are alleged to have been trafficked is a big factor. Someone’s criminal history, in other words, if someone has prior convictions, is a factor. And also, their role in the offense – were they an organizer or a leader, that type of thing – and the offense itself. It’s a formula designed to make federal sentences uniform and it’s a huge part of federal practice and something that’s very important to understand anytime you’re in federal criminal court.
