In this episode of our segment on WMBF News, Greg McCollum and Halley Murrow discuss Civil Forfeiture in South Carolina.
Greg explains that if the police find a large amount of cash, their instinct is to seize the money and take it, and that it’s done on the theory that it’s usually drug money, but many times that’s not the case. He says that they just have to have probable cause: if they find money, and they think there’s something illegal about it, then they seize the money right then. And the person who had their money seized does not have access to it until a court determines whether the seizure is approved.
