What is a detention hearing in federal court?

A detention hearing is basically another name for a bond hearing. It usually encompasses a probable cause hearing, or what’s called a preliminary hearing. Usually the language used may be a little different than what people are used to, but a detention hearing is a bond hearing.

The factors are whether or not the person is a flight risk, or the person is a danger to the community. Most non-violent crimes, people will be released without having to post money. Certainly, it’s called an unsecured release. A secured release is a bond where someone has to put up collateral or money. It’s a very important right. It happens quickly when someone’s arrested, so it’s very important to take appropriate steps to try to make sure that you can be released from custody.
