If your driver’s license is suspended as a result of DUI arrest (in other words, if you refused to take the breath test or your breath test reading was too high), an Administrative Hearing is conducted. It’s separate from your DUI trial; it’s related to your DUI case, but it’s not your DUI case.
The Administrative Hearing is conducted by your lawyer and the officer, if the officer appears, and the Hearing officer or judge. In general, we do not ask our clients to attend the Administrative Hearing because we attend it for them. Of course, if you are not represented, you would absolutely need to go and have to go in order to defend yourself. At the Administrative Hearing, many times we are able to get the person’s license reinstated.
The Administrative Hearing, once requested, usually takes about six to eight weeks to occur, sometimes maybe a bit longer, but it’s very important to have that and do everything possible to get your driver’s license reinstated.
